Interpretation:

2.1. "You" means the person whose order for the "Goods" is accepted by Digital Playworld.
2.2. "Goods" means the Goods which "Digital Playworld" will supply in accordance to your order.
2.3. "Digital Playworld", " "Us", "We" means "Digital Playworld"
2.4 "Terms" means these standard Terms and Conditions of sale set out in this document and includes any special terms agreed either verbally or in writing between us.
2.5 "Contract" means the Contract for the purchase and sale of the Goods.

Basis of the Sale:

3.1 These Terms shall govern the sale and supply of Goods by Digital Playworld to you. All other terms and conditions of trading are excluded.
3.2 Any error or omission in any information or document issued by Digital Playworld or their affiliated companies shall be subject to correction provided that the correction does not affect the contract.
3.3 No offer submitted by you for the purchase of goods from Digital Playworld shall be accepted until we have confirmed receipt of your offer and have accepted it, whether this be verbally, in writing or by email. Acceptance is deemed effective upon Digital Playworld sending you a receipt.

Pricing:

4.1 The price of our goods shall be our quoted price in Pounds Sterling as default.
4.2 The price of the goods is the price you pay and all customers will pay this price.
4.3 You shall be liable to pay our charges for delivery which may vary depending on your location (if outside the UK) and the items ordered.
4.4 Digital Playworld delivery charges of just £2.95 for the UK & Northern Ireland do not include any expenses for customs duty, VAT or any other charges that may occur other than our normal delivery charges. You are responsible for such charges should they be levied. (see item description for products that are shipped from outside the EU).
4.5 All charges must be paid prior to delivery. Legal ownership of the Goods remains with Digital Playworld until full payment has been received by us.

Copyright:

5.1 All trade marks and logos displayed on the site are either registered or unregistered trade marks of their rightful owners. You may not use any trade marks without the written permission from their owners.

Exclusions:

6.1 Any exclusions of liability in these terms do not affect your statutory rights and shall not apply to any liability arising from death or personal injury caused by negligence of Digital Playworld or any of its employees or agents.
6.2 We shall not be liable to you for any loss or damage (whether loss of profit or otherwise) arising from your use of this site, it's material or contents.

Use of Information:

7.1 While every effort is made to ensure the information that is contained on this site is correct, Digital Playworld will not be held responsible for any errors.
7.1.1 If a pricing error is made by Digital Playworld then we reserve the right to refund any payments to you. We do not have to warrant a sale if we have made a pricing or descriptive error.
7.2 You may activate any links on the site leading to websites which are not under the control of Digital Playworld and therefore any responsibility or liability for the material on the linked site is excluded by Digital Playworld.
7.3 Linking to this site is permitted by Digital Playworld only if in good nature. Otherwise, prior permission must be obtained.

Monitoring:

8.1 Digital Playworld often monitors and reviews bulletin boards, transmissions, postings, discussions and the like on this site or relating to this site.

Jurisdiction:

9.1 These terms will be governed by English Law and in the case of dispute will be submitted in the non-exclusive jurisdiction of the English Courts. If you are accessing this site from outside the UK then you are responsible to ensure compliance with any local laws if such laws are applicable.

Availability: 10.1 All products purchased are subject to availability. If products you order become unavailable we will notify you and, if we have received a payment for the unavailable products, we will ask if you are prepared to wait until we restock the items or if you would prefer a refund (excluding items shippied from outside the EU)
10.2 Most pictures of products show the exact model and colour that you will receive, however please note that all pictures are for illustrative purposes only and actual items may differ.
10.3 If your order consists of items in stock and items not in stock then we will wait until we have received the out of stock items before dispatching your complete order. In other words we will only send out one complete order. We would contact you before hand though and give the option of a refund should this happen.

Delivery:

11.1 Delivery is charged at a set fee of just £2.95 for all UK & Northern Ireland customers and will be added when you check out. For deliveries outside the Mainland UK, Ireland & Europe contact us for costs.
11.2 Delivery times vary depending on what time the order reaches us and the next available posting date. We aim to deliver your order within 2-3 days for in stock items. If an item is out of stock, we will contact you immediately to arrange an alternative date or offer a refund. For deliveries coming from outside the EU (see item description) please allow an additional 10-14 working days.
11.2a Important note for any items ordered that are shipped directly to you from our partners outside the EU (see item description) - We can not take any responsibility for any import duties, customs tax or VAT charged by the courier upon delivery. We try to minimise these costs for you, and more often that not these are not charged, although we cannot guarantee this.
11.3 We may use the courier service we believe to be the most reliable and effective depending on your order. Because we rely on third parties to delivery your order, we cannot be held responsible for their reliability and accuracy.
11.4 If products are returned to us as undeliverable they will be subject to an additional charge before being re-shipped. Alternatively, we may refund you the cost of the products minus the delivery charge (the real cost to us) plus an administration fee.
11.5 On all orders, we will collect proof of posting, or if sent via courier, we will be issued with a tracking number which you may ask for at any time. If you do not receive your order, then you will be able to contact our courier to see what compensation is claimable (if any). If you require extra compensation then you must ask us prior to placing an order and pay the extra for this insurance cover.
11.6 Overseas orders can be sent via Airmail, Surface Mail or International Signed For although any non UK customers should contact us prior to placing an order so we can calculate the shipping costs. Please note that Surface Mail can take up to 28 days for an order to reach you.
11.7 Orders sent by First Class post are unrecorded and cannot be tracked. Once they leave our warehouse then we cannot be held responsible for the order. If an order that was sent by First Class delivery goes missing then we will attempt to claim compensation from Royal Mail. If the claim is successful then we will contact you to arrange a replacement or refund. However we rarely use standard 1st class, we usually use 1st class recorded delivery as standard for small items.
11.8 Recorded delivery is service that we use regularly. Orders with Recorded delivery receive a tracking number which may be obtained by you at any time. Should the order go missing then we will attempt to claim compensation up to the value of £32. If you require extra insurance, then Special Delivery must be purchased at the time of making your order which can cover orders up to £500. Please contact us prior to placing an order should you require this cover.

Returns & Refunds:

12.1 You have the right to cancel your order at any time up to the end of the first working day following the day on which you received the products. It is compulsory for you to notify us of the reason of cancellation. If you wish to cancel your order please send an email to customerservices@digitalplayworld.co.uk with details of your cancellation. You must state your name, a description of the goods and your order number.
12.2 Any use of the goods beyond that necessary to inspect them on delivery will invalidate your right to cancel the order. If we believe items have been damaged due to lack of care by yourself then we reserve the right to refuse a full refund or replacement. If damage is made when returning the goods back to us, then it is your right to seek compensation from your carrier used to return the item.
12.3 . We resrve the right to deem any returned item as having been used/tested in which case there will be a re-stocking fee charged.
12.4 All products bought from our website are guaranteed for 12 months from the date of purchase. If a product proves to be faulty within that period you may return it to us for a refund or exchange unless a manufacturers guarantee has been issued then you will need to contact the manufacturer. Manufacture guarantees are enclosed within product packaging and it is your resposilbility to register for the guarantee. In the unlikley event of an item being faulty that was shipped to you from one of our suppliers from outside the EU (see item description), it is your responsibility to return the item back to the supplier (this includes the shipping costs back to the supplier).
12.5 If you have paid p&p on your order then we reserve the right not to refund this cost to you if you return an item, but will only refund the cost of the goods to you. If the true cost of P&P exceeds the amount you paid (£2.95) then we will refund the amount you paid minus the amount we paid for postage. The minimum amount for postage will be £2.95 per order.
12.6 Paypal refunds can only be issued up to 60 days after the initial period. If for whatever reason, we need to refund you after the 60 days have expired then you will be responsible for Paypal's charges for receiving the money from us.
12.7 If an order or product has been returned to us that was paid for with a credit note or voucher then a refund will be issued in the form of another credit note or voucher.
